The manufacturer must draw up certain technical documentation. The manufacturer shall operate an approved quality system for the production, inspection and testing of the finished product and shall be subject to surveillance. This applies only to some types of batteries.
These include performance and durability requirements for industrial batteries, electric vehicle (EV) batteries, and light means of transport (LMT) batteries; safety standards for stationary battery energy storage systems (SBESS); and information requirements on SOH and expected lifetime.
Performance and Durability Requirements (Article 10) Article 10 of the regulation mandates that from 18 August 2024, rechargeable industrial batteries with a capacity exceeding 2 kWh, LMT batteries, and EV batteries must be accompanied by detailed technical documentation.
Annex I of the regulation lists restrictions for three substances, regardless of their incorporation into appliances. The restricted substances are as follows: a. Batteries should not contain more than 0.0005% of mercury by weight. b. Portable batteries should not contain more than 0.002% of cadmium by weight.
This Regulation applies to portable batteries, automotive batteries, electric vehicle batteries and industrial batteries. It applies to all of these categories of batteries, regardless of their shape, volume, weight, design, material composition, chemistry, use or purpose.
Labelling requirements will apply from 2026 and the QR code from 2027. The regulation amends Directive 2008/98/EC on waste management (see summary) and Regulation (EU) 2019/1020 on market surveillance and compliance of products (see summary).
