Management of chemicals is covered by Art. 6, which includes a process to regulate hazardous substances used in batteries, duplicating the existing and well-established REACH restriction process set out in Annex XVII of Regulation (EC) No 1907/2006.
The Batteries Regulation applies to all categories of batteries, including portable batteries, starting, lighting and ignition (SLI) batteries, light means of transport (LMT) batteries, electric vehicle (EV) batteries and industrial batteries that are placed on the EU market.
In line with the circularity ambitions of the European Green Deal, the Batteries Regulation is the first piece of European legislation taking a full life-cycle approach in which sourcing, manufacturing, use and recycling are addressed and enshrined in a single law.
The proposal seeks to introduce mandatory requirements on sustainability (such as carbon footprint rules, minimum recycled content, performance and durability criteria), safety and labelling for the marketing and putting into service of batteries, and requirements for end-of-life management.
10 December 2020 is geared towards modernising EU legislation on batteries in order to ensure the sustainability and competitiveness of EU battery value chains. The proposal is part of the European Green Deal and related initiatives, including the new circular economy action plan and the new industrial strategy.
Negotiations on the proposal for a new EU Regulation on sustainable batteries have finally concluded. On 10 July 2023, the Council of the European Union adopted the new Regulation concerning batteries and waste batteries (EU) 2023/1542 (the " Batteries Regulation ").
